Overview

Mr. Gauss is an experienced litigator who represents clients in commercial disputes and other complex civil litigation.  He focuses his practice on representing individual and corporate policyholders in insurance coverage disputes and other forms of strategic risk management. He has secured coverage for clients under a wide-variety of insurance policies, including Directors and Officers, commercial crime, first-party property, builders’ risk, and commercial general liability policies.  Such recoveries have been obtained through negotiation, alternative dispute resolution and litigation in state and federal courts around the country.  Mr. Gauss also represents clients in a variety of commercial disputes related to construction defects, product recalls, asset purchase agreements and breaches of supply-chain contracts.

Prior to moving to Oregon and joining PFG in late-2018, Mr. Gauss practiced in Washington, DC, where he was recognized by Super Lawyers as an Insurance Coverage “Rising Star” from 2014-2019.

Representing a large private equity firm and affiliated individuals in successfully pursuing insurance coverage for lawsuits alleging breach of fiduciary duty, securities fraud and negligent misrepresentation

Representing a Fortune 100 company in obtaining insurance coverage for costs incurred defending against an investigation by the U.S. Securities and Exchange Commission

Securing millions of dollars in defense costs for antitrust lawsuits on behalf of an international trade organization for market participants of over-the-counter derivatives

Representing numerous businesses and homeowners in property damage claims stemming from natural disasters, including over 1,200 homeowners and businesses in flood insurance claims stemming from Hurricane Sandy

Advising international food companies on insurance recovery efforts related to product recalls and natural disasters and representing them in pursuing claims against suppliers, vendors and equipment manufacturers

Representing one of the world’s largest safety equipment manufacturers in litigation over hundreds of millions of dollars in insurance coverage for asbestos-related liabilities

Litigating on behalf of an owner of a boutique hotel and recovering tens of millions of dollars for construction defects

Representing a global construction company on insurance and indemnification issues arising out of the partial collapse of a building and related business interruption loss
